Poland: derogations from Regulation 561/2006 – how to describe the printout?

The Polish government has decided to introduce temporary derogations from the application of the provisions of Article 6 sec. 1-3, Article 7 and Article 8 sec. 8 regarding driving times, breaks and rest periods for drivers engaged in domestic and international road transport of passengers and goods. The derogations are in effects from March 4 to April 2.

According to the derogations:
– the daily driving time must not exceed 11 hours;
– the weekly driving time must not exceed 60 hours;
– the total driving time for two consecutive weeks must not exceed 96 hours;
– after driving for five and a half hours, the driver is entitled to an uninterrupted break of at least 45 minutes;
– the driver, if he so chooses, may also take a regular weekly rest period in the cabin, provided there are adequate sleeping facilities for each driver and the vehicle is parked.

In addition, drivers are allowed take the regular weekly rest in the cabin of the vehicle. Importantly, the derogations apply only to transports carried out within the territory of Poland. After leaving Poland, drivers are obliged to follow the standard regulations.

Drivers must also note on the back of their tachograph charts or printouts from a digital tachograph the reasons why they are exceeding the normally permitted limits. The description should be as follows:
– In Poland – w dniu ………… realizacja przewozu na podstawie odstępstwa wprowadzonego w Polsce Dz.U. 293, Artykuł 14, Ustęp 2 rozporządzenia 561/2006.
– Abroad – On …………. performance of the carriage on the grounds of exception implemented in Poland J.o.L. 293, Article 14 paragraph 2 of the Council Regulation 561/2006.
